There are no disputes over support, division of property, or child custody, and the couple agrees to the terms of the divorce without the need for a trial.
A contested divorce is one in which the couple cannot agree on issues such as child custody, division of property, and spousal support. When an acceptable agreement is not reached through mediation or negotiation, it becomes necessary to go to trial to protect the client’s best interests. Grounds for a divorce or a legal separation are the same. Either judgment may be had on the no-fault basis of irreconcilable differences, and it is not necessary to prove that one party is at fault in some way for ending the relationship. Other actions that must be completed during the process can include obtaining a temporary court order by submitting an Order to Show Cause hearing, Discovery, and Preparation of the Preliminary Declaration of Disclosure. In California, parties must wait six months before the divorce is finalized. The exception is a summary dissolution, when parties have no children, have been married for less than five years, don’t own real estate, and have relatively limited property and debts. Some paperwork still needs to be filed, but it is unnecessary to wade through many procedures and appearances required for a regular divorce.
